This explanation, provided by the Ombudsman, clarifies the Law of Ukraine “On Amendments to Article 301 of the Law of Ukraine ‘On Child Protection’ Regarding the Representation of Certain Children During Martial Law in Ukraine,” adopted by the Verkhovna Rada of Ukraine on May 22, 2022. The law aims to protect the rights of children evacuated abroad due to war by establishing temporary legal representation for minors under 18. It covers children who are placed in round-the-clock care institutions and foster families, ensuring they have representation while residing outside Ukraine.
This legislative act was adopted in response to the significant challenges faced by children during martial law, especially those forced to leave the country. By regulating issues of temporary representation, the law enables these children to exercise basic rights to education, medical care, social support, and other essential services, even while abroad.
