The purpose of the Refugee Act of 2012 is—as Section 3 states—”is to give effect, within the Republic of South Sudan, to relevant international treaties, conventions and the principles and standards relating to refugee protection; to provide for the reception into South Sudan of asylum seekers; to regulate applications for and recognition of refugee status; to provide for the rights and obligations flowing from such status; and to provide for related matters.” The act includes provisions that directly address children, notably Section 36, which states, “Any child who is found under circumstances which clearly indicate that he or she is a child in need of care as provided in the Child Act, 2008, must be assisted in applying for asylum in terms of this Act.”
